**BDG - SCHOOL ATTORNEY** **Last Updated Date:** 11/26/2013 **Adoption Date:** 01/10/2006 Subject to acceptance of the provisions of the law and supportive action by the Selectboard, the School Committee may employ legal counsel for the general purposes of the Committee from funds appropriated for school purposes. The following are among the general duties of legal counsel with reference to educational matters: 1. To advise and furnish the superintendent or School Committee legal opinions, verbally and in writing, as directed, on all matters and questions of law, including interpretations of old and new statutes. 2. To attend School Committee meetings at the request of the School Committee or superintendent. 3. To prepare legal instruments and contracts, including resolutions, advertising bids and all other legal papers as directed by the superintendent or School Committee. 4. When needed, to commence and prosecute all legal action brought by the superintendent or School Committee. 5. To represent and defend school employees or School Committee members in any legal action against them which has arisen from the carrying out of regular responsibilities and the performance of regular duties. **Policy References:** M.G.L. 71:37E; 71:37F
